1. Introduction

1.1. The website linked to the domain name “www.locman.live” (hereinafter, the “Site”) is owned by LOCMAN S.P.A. (Tax ID 08504700157, VAT ID 01190380491) with registered office at 57034 – Campo Nell’Elba (LI), Piazza Giovanni da Verrazzano, no. 7, in the person of its legal representative pro tempore (hereinafter, the “Company”) and is dedicated to the presentation of the Company and to the online offer for sale of watches, watch accessories, clothing, and eyewear under the “LOCMAN®” brand (hereinafter, the “Articles”).

1.2. These terms and conditions of the Site (hereinafter, the “T&C – Site Use”) govern the ways in which the Company grants users of the Site (hereinafter, the “Users” or, in the singular, the “User”) the right to browse the Site and purchase the Articles.

1.3. Browsing, registering a personal account, using the Site's contact form, and purchasing Articles through the Site are subject to acceptance of these T&C – Site Use, the personal data processing policy (hereinafter, “Privacy Policy”), and the detailed policy on the use of cookies (hereinafter, “Cookie Policy”), an acceptance that is considered finalized through the consent to cookies presented upon opening the site itself. Should the User not intend to accept these T&C, the Privacy Policy, and the Cookie Policy, they may browse the site by accepting only the cookies necessary for the functioning of the site; otherwise, it will be impossible to use it. 1.4. Furthermore, the terms and conditions of sale on the Site (hereinafter, the “T&C – Sale”) are also published on this Site.

2. Services

2.1. Through the Site, the Company offers the following services (hereinafter, the “Services”).

2.2. Presentation and offer for sale of the Articles. Through the Site, the User can purchase the Articles offered for sale by the Company. To learn about the terms and conditions of sale of the Articles offered by the Company on the Site, the User is invited to consult the relevant T&C – Sale.

2.3. Newsletter. By completing the registration procedure for the newsletter offered on the Site and therefore authorizing the Company to process the data provided, the User agrees to receive messages, including advertising, processed also by means of automatic third-party message sending tools. The User may unsubscribe from the newsletter at any time by clicking on the appropriate link at the bottom of the messages or by writing to info@locman.live. The Site's newsletter service is not intended for minors under 16 (sixteen) years of age or minors whose age makes the processing of their personal data illegal or requires parental consent for the processing thereof pursuant to other local laws. For further information in this regard, the User is invited to consult the "Minors" section of the Privacy Policy.

3. Registration on the Site

3.1. Registration on the Site is free of charge. To register, the Consumer must click on the image “” in the header of the Site, then click on “REGISTER”, then fill out the registration form by entering a valid and functioning e-mail address and verifying it with the code sent, then accept the Privacy Policy by clicking on the appropriate box and, finally, click on "REGISTER" at the bottom of the form. Registration will be confirmed to the Consumer via e-mail.

3.2. The registration data can only be used by the User and cannot be transmitted to third parties. The User undertakes to keep them secret and to ensure that no one has access to them. The User shall immediately inform the Company of any suspicion of improper use and/or disclosure.

3.3. The User warrants that the personal information provided during the Site registration process is complete and truthful. The User agrees to indemnify the Company from any obligation, compensation for damages and/or penalties deriving from the User's violation of the rules governing registration on the Site.

4. Permitted use of the Site

4.1. The Company authorizes the User to use the Site for personal, non-commercial use only and exclusively to take advantage of the Services present on the Site and, if applicable, to register on the Site or request information.

4.2. In any case, the User must use the Site in compliance with these T&C – Site Use.

5. Prohibited use of the Site

5.1. The User may not modify, publish, duplicate, license, assign, republish on third-party sites, or sell the services, documents, images, texts, or content published on the Site, unless expressly authorized by the Company.

6. User Responsibility

6.1. The User agrees to be solely responsible for any failure to fulfill the obligations under these T&C – Site Use and for the consequences of any violation.

6.2. The User who uses the modules present on the Site dedicated to the contact form is obliged to provide truthful, correct, verifiable, and updated personal data.

7. Intellectual property of the Company

7.1. The User acknowledges that the name and registered trademark “LOCMAN®” (and any of its graphic variants), the design of the Articles, the layout, the structure, the texts, the images, the documents of the Site, the design of the pages, and its elements are subject to the exclusive rights of the Company or licensed to the Company (hereinafter, the “Intellectual Property”).

7.2. The User of the Site acknowledges the validity of the Intellectual Property and undertakes not to contest it, and acknowledges that they have no rights to all or part of the Intellectual Property.

7.3. The Site may contain intellectual property rights of third parties, which the User undertakes to respect.

7.4. It is forbidden for the User to use, even partially, the Intellectual Property by any means, analog or digital, without the written authorization of the Company. It is likewise forbidden for the User to register or attempt to register all or part of the Intellectual Property.

8. Absence of warranty

8.1. The Site and the Services rendered by it, which are provided as they are and in their current legal state, do not guarantee the User that the use of the Site will be uninterrupted, timely, secure, or error-free, that any information obtained by the User as a result of using the Site will be correct or reliable, and that any operating defects will be repaired.

8.2. The Company is not liable, either to the User or to subjects directly or indirectly connected to the User, for damages, claims, or losses deriving from disservices or suspensions of the Site that depend on the User themselves, third parties, or are caused by force majeure or fortuitous events.

8.3. The existence of a hypertext link pointing to the Site from another third-party website, or pointing from the Site to another third-party website, does not imply approval or an acceptance of liability by the Company regarding the content or use of the sites linked in this way.

8.4. The Company reserves the right, at any time, without any form of notice and without any obligation of compensation and at its sole discretion, to close the Site and/or make any changes and/or additions to its content that it deems appropriate.

9. Limitation of liability

9.1. No condition, warranty, or other term applies to the Site except to the extent that they are expressly set forth in these T&C – Site Use.

9.2. To the limits established by law, the Company shall not be liable to the User or third parties for any indirect, incidental, or consequential damage that may be suffered from the use of the Site, including loss of profit, absence of profit, damage to reputation, and others.

9.3. No provision of these terms affects the mandatory rights of consumers, nor does it exclude or limit the liability of Locman in the event of fraud, gross negligence, or for damage to life, health, or the physical integrity of the customer.

10. Privacy

10.1. The User's personal data are processed by the Company in compliance with the current legislation on personal data protection. 10.2. For more information, including the purposes of processing, please refer to the Privacy Policy and the Cookie Policy.

11. Communications and complaints

11.1. The User may request any information and/or send communications and/or submit complaints. Such communications directed to the Company will be valid if forwarded via e-mail to info@locman.live, except for complaints for which the appropriate form is provided.

12. Applicable law and dispute resolution

12.1. These T&C – Site Use are governed by Italian law.

12.2. Without prejudice to the provisions of mandatory regulations for consumer protection, for any dispute arising from the use of the Site or related to these Terms, the Court of Milan will have exclusive jurisdiction. If the user acts as a consumer, the mandatory territorial jurisdiction will be that of the judge of the place of residence or domicile of the consumer, in accordance with EU Regulation no. 1215/2012.

13. Final provisions

13.1. These T&C – Site Use repeal and replace any previous agreement, understanding, negotiation, written or oral, reached between the User and the Company.

13.2. Should one or more provisions of these T&C – Site Use be considered invalid or declared as such pursuant to the law, the other provisions will continue to have full force and effect.

13.3. The circumstance that the Company does not at any time assert the rights recognized by one or more provisions of these T&C – Site Use cannot be understood as a waiver of such rights nor will it prevent the subsequent demand for their observance.

13.4. These T&C – Site Use may be subject to updates. The User is requested to view the published version and the date of update.
